you, when you agree to the Terms and Conditions below.

COMPETING CHOIR OR SINGER
TERMS AND CONDITIONS
These terms and conditions relate the use of images
by competing choir or singers from BBC Radio 3 Choir
of the Year 2006 Finals. Members of the press must refer
to separate Terms and Conditions on the Choir of the
Year website.
These terms and conditions are legally binding.
Read them carefully before using any images and keep
this copy for your records. NO variation of these terms
or conditions shall be effective unless agreed in writing
from Kallaway Ltd. Failure to comply to these terms
and conditions will result in a fine and possible disqualification
from future Choir of the Year competitions.
The image library is for use by the press or for personal
use by the choirs and singers involved in the Finals
of BBC Radio 3 Choir of the Year 2006 competition. If
you are not a bona fide member of the press, a choir
representative or singer from a choir that competed
in BBC Radio 3 Choir of the Year Finals 2006, you are
expressly forbidden from entering the image library
or downloading any images whatsoever.

1 USE OF IMAGES
1.1 Images shall only be downloaded and used by bona
fide choir representatives or singers that competed
in the BBC Radio 3 Choir of Year 2006 category finals
or grand finals and are resident in the United Kingdom.
1.2 Images shall only be used for personal display or
publicity, promotion or marketing material from which
the choir or singer or any other third party does not
benefit financially in any way whatsoever.
1.3 Images for publicity, promotion or marketing may
only be used in the United Kingdom and only in a manner
that is deemed legal and responsible under United Kingdom
law.
1.4 All other use is expressly forbidden without the
prior permission, in writing, from Kallaway Ltd.
1.5 You acknowledge that images are Kallaway Ltd's valuable
property. Ownership and copyright remains with it at
all times.
1.6 You may not copy, duplicate, loan or transmit any
image or any part thereof without Kallaway Ltd's written
permission except so far as is incidentally and wholly
necessary to the process of publishing the image effectively
within the terms of this agreement. All third parties
provided with the image for the process of publishing
must agree, in writing, to destroy all copies of the
image following completion of their task, prior to the
image being provided.
1.7 Images shall be published with full accreditation
as detailed below.
2 ACCREDITATION
2.1 All images in the media centre are provided
with the name of the choir and the photographer who
took the picture. Each image used must be captioned
in full with the caption below:
[Name of choir] competing in the Finals of BBC Radio
3 Choir of the Year 2006, [Name of photographer],

3 MISCELLANEOUS
3.1 You alone shall use the username and password
issued. You shall not provide them to any other person
wishing to use the picture library. They must agree
to these terms and conditions independently to gain
access to the library.
3.2 As the recipient you agree to indemnify Kallaway
Ltd with respect to any claims or damages or any loss
or costs arising in any manner from the reproduction,
without proper reduction rights of any picture supplied
to you by Kallaway Ltd.
3.3 While Kallaway Ltd takes all reasonable care in
the performance of this agreement generally Kallaway
Ltd shall not be liable for any loss or damage suffered
by the recipient or by any third party arising from
the use or reproduction of any material.
3.4 These terms and conditions are legally binding for
the time you hold any of the images downloaded from
this site.
4 UNAUTHORISED/INCORRECT USE OF IMAGES
4.1 Unauthorised or incorrect use of an image could
result in a minimum £1,000 charge being levied
by Kallaway Ltd or the image Copyright Owner; disqualification
from future Choir Of the Year competitions and reporting
to the appropriate UK authorities.
