PRESS USE OF IMAGES - TERMS & CONDITIONS
These terms and conditions relate to press use of the images only. Singers and choir representatives must refer to separate Terms and Conditions on the Choir of the Year website.

These terms and conditions are legally binding. Read them carefully before using any images and keep this copy for your records. NO variation of these terms or conditions shall be effective unless agreed in writing from Kallaway Ltd.

The image library is for use by the press or for personal use by the choirs and singers involved in the Finals of BBC Radio 3 Choir of the Year 2006 competition. If you are not a bona fide member of the press, a choir representative or singer from a choir that competed in BBC Radio 3 Choir of the Year Finals 2006, you are expressly forbidden from entering the image library or downloading any images whatsoever. 1. ACCREDITATION

1.1 You acknowledge that images are Kallaway Ltd's valuable property. Ownership and copyright remains with it at all times.

1.2 All images in the media centre are provided with the name of the choir and the photographer who took the picture. Each image used must be captioned in full with the caption below:

[Name of choir] competing in the Finals of BBC Radio 3 Choir of the Year 2006, [name of photographer], © Kallaway Ltd 2006.


2. USE OF IMAGES

2.1 Images shall only be downloaded and used by bona fide members of the press for publishing in recognised media.

2.2 Images shall be published with full accreditation as detailed above

2.3 Any other use of the images is expressly forbidden including promotion and advertising.

2.4 Images shall not be altered or manipulated, added to, or have any part deleted without prior written consent.

2.5 You may not copy, store, loan or transmit any image without Kallaway Ltd's written permission except so far as is incidentally and wholly necessary to the process of publishing the image effectively within the terms of this agreement.

2.6 You agree to destroy all images downloaded or emailed, including any pre-press or pre-production copies of the images and any copies or records of the images held on a database within 30 days of the date of receipt of the images or completion of the publication/media in which they are being used or which ever is sooner.


3 MISCELLANEOUS

3.1 You alone shall use the username and password issued. You shall not provide them to any other person wishing to use the picture library. They must agree to these terms and conditions independently to gain access to the library.

3.2 As the recipient you agree to indemnify Kallaway Ltd with respect to any claims or damages or any loss or costs arising in any manner from the reproduction, without proper reduction rights of any picture supplied to you by Kallaway Ltd.

3.3 While Kallaway Ltd takes all reasonable care in the performance of this agreement generally Kallaway Ltd shall not be liable for any loss or damage suffered by the recipient or by any third party arising from the use or reproduction of any material.

3.4 These terms and conditions are legally binding for the time you hold any of the images downloaded from this site.


4 UNAUTHORISED/INCORRECT USE OF IMAGES

4.1 Unauthorised or incorrect use of an image will result in a minimum £1,000 charge being levied by Kallaway Ltd or the image Copyright Owner.
